These Terms of Service ("Terms") govern your use of the Primary Care mobile application ("the app," "we," "our"). By using the app, you agree to these Terms.

1. Medical Disclaimer

Primary Care is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment.

All AI-generated insights, health summaries, and lab report analyses are for informational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you read in this app.

If you think you may have a medical emergency, call your doctor or emergency services immediately. Primary Care does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned in the app.

2. AI Limitations

The app uses artificial intelligence (Anthropic's Claude) to provide health insights and answer questions. You acknowledge and agree that:

AI responses may be inaccurate, incomplete, or outdated.
AI analysis of lab reports or health data may contain errors.
You should not make medical decisions based solely on app output.
AI responses do not constitute a doctor-patient relationship.
The app cannot diagnose conditions, prescribe medication, or provide emergency guidance.

3. User Responsibilities

By using Primary Care, you agree to:

Provide accurate information when using the app.
Consult qualified healthcare providers for medical decisions.
Not rely on the app as your sole source of health information.
Use the app in compliance with all applicable laws.
Not attempt to reverse-engineer, modify, or misuse the app.

4. Intellectual Property

The Primary Care app, including its design, code, content, and branding, is owned by Primary Care and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial purposes.

You may not copy, modify, distribute, sell, or create derivative works based on the app without our prior written consent.

5. Limitation of Liability

To the maximum extent permitted by law:

The app is provided "as is" and "as available" without warranties of any kind, express or implied.
We do not warrant that the app will be uninterrupted, error-free, or that any health information provided will be accurate or complete.
We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the app.
Our total liability shall not exceed the amount you have paid for the app in the twelve months preceding the claim.

6. Indemnification

You agree to indemnify and hold harmless Primary Care and its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the app or violation of these Terms.

7. Termination

We reserve the right to terminate or suspend your access to the app at any time, for any reason, without notice. You may stop using the app at any time by deleting it from your device, which also permanently deletes all locally stored data.

8. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the app after changes constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the app shall be resolved in the courts of the State of California.
